United States Supreme Court’s Decision: National Federation of Independent Business vs. Sebelius, Secretary of Health and Human Services

A Patriot’s Opinion – June 29, 2012

Prelude

On June 28, 2012, the United States Supreme Court upheld Patient Protection and Affordable Care Act as Constitutional in a majority decision with Chief Justice John Roberts presuming to have breaking the tie and reading the decision. Upon the news breaking and spreading, proponents of the Act celebrated in jubilation while opponents expressed outright anger and disbelief. The media in my opinion has made blanket states in its reports without fully reading or comprehending what was in the decision and in all a cases I believe, a rush to judgment has been made without fully grasping the full weight of the decision.

Now more than ever, it is the duty of every citizen to read study and attempt to interpret the Constitution along with the decisions of the courts if Our Nation is to avoid devastation by means of rebellion, war or an economic failure.

Over the past decades, we as a people, have witnessed abuses of the United States Constitution by County, State and Federal governments thus supporting the words of Lord Acton who said “Power tends to corrupt, and absolute power corrupts absolutely. Great men are almost always bad men, even when they exercise influence and not authority, still more when you super add the tendency or the certainty of corruption by authority.” One must the question what we see today. Is it any wonder that those in government tend to be rich and those few in government who lead humble lives tend to be scrutinized by members and leaders of their own party? It has thus been my experience in my years of Patriotic Activism that those in power fear questions more than armed rebellion. This paper and opinion will then also ask many questions in the decision along with opinions and views of one person.

The Purpose of Existence & the Purpose of Government

Since this law hit the floor as I bill I began to question those people in office and those potential candidates one question. “Are we a free people or are we a property of the state?” The question is a very fundamental question by which was answered in the Constitution. Article IV – Section 4 – Republican government “The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.” It is my belief that congress has established itself more as “lawmakers” than representatives and have forgotten that their first duty is to protect the rights of all Americans and not run their lives. While many may disagree with me and point to some accomplishment or another, I would submit to you that the laws are far and few. Note that Jefferson’s Declaration of Independence is but one page long and has stood the test of time as who wrote it.

Of Democrats

The principles of the Democrats are simple. People have needs and some people have more needs than others. As a result it is up to the government to take from the fortunate and share it with the less fortunate. This system of collectivism has done more harm than good throughout the decades. While it is true that some need help, Democrats have taken advantage of this situation by making it a career and a call for their cause. They have gone out of their way to make sure that monies are collected by the Federal Government and distributed by them in order that they might be seen as generous. Generous indeed, with other people’s money rather than their own. In exercising this evil practice, they have stripped local charities by taxing everyone in order that their political party may be made the center of attention. The result, a broke social security system, a broke Medicaid system, Amtrak broke etc. Evidence that the federal government cannot fix social problems. In the eyes of the Democrats your existence here in the United States is that you support and sacrifice yourself for the sake of others.

Of Republicans

The Republican empire of only which those with money or evil influence can help them get into office and retain that power. I have now personally witnessed this twice in one month. Designing and duping women who form committees for the sake of their security. Benjamin Franklin once noted that in a committee, a hot-tempered bully will dominate the group. A weak mind will attach himself to the host. Another weaker mind then collapses for the sake of peace for which he in turn talks one of the remaining two to join the group of which the group then intimidates the last man standing into the influence of the bully in the name of “getting things done”.

In summary, the American People then look to the courts, more precisely, the United States Supreme Court to remedy the ills of an evil government of whom they have to confidence and the proof is in the polls that reflect a congress with one of the lowest approval ratings in history. The result, the people find themselves once again disappointed as the court upholds the federal governments mandate or did they? That is the question that is pondering in my mind as I read the decision, study it and attempt to interpret the decision myself. This will be no easy task and will require weeks of study and research the decision.

The Qualifications, References & Questions

The Constitution is a rather easy task that has been made complex only by those who have decided to make it complex for their own gains. In my studies I have found that there were fifty-five framers of the United States Constitution. Of the fifty-five, two were doctors, one was an educator, one was a farmer, one was an inventor, thirty were lawyers, one was lawyer/merchant, ten were merchants, one a minister/lawyer, five were politicians, one a soldier politician, one a teacher and one a soldier. I then look at the occupations of average Americans and note that the average American was no different than anyone listed here. Two special notes here, the Inventor was none other than our own Benjamin Franklin. The Soldier listed here listed no rank, no division or military occupation and leaves us only with the title of “soldier”. The “soldier in question” was none other than George Washington, the First President of the United States under the United States Constitution. The question is not then as to whether I am “qualified” to speak on the law and the Supreme Court’s decision but a statement that “You too are qualified to speak on the subject matter and must question the decision as well”. Is the health care law Constitutional? Nancy Pelosi has already said so along with other Democrat leaders have said it is and even Barrack Obama has proclaimed himself to be a Constitutional Scholar. They have presented as evidence the Supreme Court’s ruling of upholding the law as evidence but I challenge their conclusion. Roberts in his ruling has cited codified law, precedent cases, landmark cases, the Constitution, and the Federalist papers as some of his references. Missing from what I have read so far are the Anti-Federalist papers and many quotes from the Framers that show the clear intent of the United States Constitution.

Questions

There are many questions before me to which I am looking for answers. Are we still born in this nation as free beings or for the existence of others? Are we created as Free Men under Our Creator or are we property of the State? Is government the servant or the master? If government has become the ultimate master do the American people have the moral courage to apply the proper remedy? These are just among some of the few questions that I ask in my conscience. To date I have concluded that with all of the governments dealings, I can no longer support our government philosophically, financially nor morally. Do the courts exist to uphold, protect and defend our rights or to protect the rights of government by means of “law”?
